Tripod VPN Terms of Service
Effective date: 1 October 2026
1. Agreement
1.1. Parties and scope. These Terms of Service (Terms) govern Tripod VPN, its connectivity service, account facilities, connection configurations and support, together with the Tripod websites under tripod.sh that refer to these Terms (the Service). The supplier is Tripod Networks Inc., a corporation incorporated under the Canada Business Corporations Act (Tripod, we, us or our).
1.2. Definitions. Customer or you means the individual or organization contracting for the Service. A Consumer is an individual who obtains the Service for personal, family or household purposes. A Plan is the applicable service offering; a Free Plan is a Plan supplied without charge; a Paid Plan is any other Plan. An Order is the purchase summary presented before you buy, as accepted, together with any separately agreed order form. A Paid Period is a service period covered by one payment, including a renewal payment. An Enterprise Customer is an organization obtaining the Service for its authorized users through an organization-managed account. Successful Traffic is defined in section 3.3.
1.3. Formation. Before you buy a Paid Plan we display the Order and these Terms, give you an express opportunity to accept or decline and to correct errors immediately before the purchase, and send you a copy of the concluded agreement that you can keep and print, within 15 days. Upgrading from a Free Plan to a Paid Plan is a new purchase and repeats these steps. You accept these Terms for a Free Plan, and for any use of the Service that is not a purchase, by creating an account or using the Service. A person accepting for an organization must have authority to bind it.
1.4. Related terms. The Order identifies the purchased features and commercial terms. Enterprise Customers contract under separate enterprise terms, which prevail over these Terms to the extent of an express inconsistency. Nothing in an Order or in enterprise terms reduces mandatory consumer rights. The Privacy Policy describes our handling of personal information; accepting these Terms does not replace any separate privacy consent that the law requires.
2. Eligibility and accounts
2.1. Adults and authority. Individual Customers and users must be at least 18, or the applicable age of majority if higher, and have legal capacity.
2.2. Personal use. A consumer Plan is for use by its purchaser alone. You must not share, lend, sell or otherwise provide your credentials or access to anyone else. The number of devices and simultaneous connections is the number stated in the Order. Enterprise access is governed by the enterprise terms.
2.3. Account security and responsibility. You must keep required account and contact information accurate and take reasonable care of authentication devices, passwords, connection credentials and configuration links. A configuration link grants access to the Service and must be kept confidential. Report a suspected compromise using section 13. You are responsible for all activity under your account, except activity caused by our failure to secure our own systems.
2.4. Contact address. A Paid Plan requires a working email address, which we use for the copy of the agreement, receipts, renewal reminders and notices. A Free Plan may be used without an email address; notices for such accounts are given in the account portal.
2.5. Enterprise administration. Enterprise Customers must manage their users’ access and give their users the notices that the law requires. Administrative authority does not authorize unrestricted monitoring. Responsibilities for information processed on an organization’s behalf are set out in the enterprise terms, not in the Privacy Policy.
3. Service and Plan limits
3.1. Connection requirements. The Service requires a working internet connection, compatible client software and appropriate settings. Compatible third-party clients may be used; we do not supply or support them and are not responsible for them. Protection extends only to traffic routed through the Service; importing a configuration does not establish full-device protection.
3.2. Disclosed limits. Before purchase, the Order states the price, currency, term, renewal arrangements, supported features, device limit and material restrictions. It also states the data allowance, what traffic counts toward it, its reset period, and the effect of reaching it. A usage period need not match a Paid Period. Service under a Paid Plan starts immediately on payment. Undisclosed numerical limits do not become contractual limits through an undefined fair-use rule.
3.3. Traffic measurement. Successful Traffic means successfully forwarded customer traffic, excluding sign-in, configuration downloads and automatic connectivity checks. We keep aggregate account-level traffic amounts and concurrent-connection counts to administer allowances and device limits, verify refund eligibility and protect the Service against misuse. These totals contain no source or destination addresses and no per-connection history. Blocked attempts do not, by themselves, establish Successful Traffic.
3.4. Routing. Routing rules may reject particular destinations, network ranges or protocols. Restrictions material to a purchase are disclosed with the Plan. Use restrictions on automated and bulk traffic are in section 6.
3.5. Changes to the Service. We may add, change or withdraw features, servers, locations, protocols and configurations, and may limit, change, suspend or withdraw a Free Plan, without notice. We may suspend all or part of the Service without notice for maintenance, to address a security threat, or to comply with law. A material change to the Service you receive under a Paid Plan is governed by section 11.
3.6. Lawful availability. You must comply with the laws that apply to your use where you use the Service. We comply with Canadian sanctions law: we do not provide the Service to or for the benefit of a listed person or to persons in the Democratic People’s Republic of Korea, may screen accounts and payments against Canadian sanctions lists, and may refuse, restrict or end a transaction or account where sanctions or export-control law applicable to us requires it. This clause does not restrict use merely because a Customer travels.
4. Payment and renewal
4.1. Seller and prepayment. Tripod is the seller for every purchase, in every country; payment providers process payments for us and are not parties to these Terms. Paid Plans are prepaid. Charges, taxes, accepted payment methods and payment timing are disclosed before an Order is accepted. You authorize only the payments expressly agreed. We do not charge late fees or provide paid Service on credit.
4.2. Subscriptions and renewal. Unless the Order says otherwise, a monthly Plan is an open-ended subscription billed at the start of each monthly period until cancelled, and a Plan with a term longer than 60 days renews at the end of the term for a further term of the same length until cancelled. Automatic renewal is on by default and is disclosed before purchase. We attempt to collect the renewal payment shortly before the current period ends and may retry if it fails. For any term longer than 60 days, we email you between 30 and 60 days before the renewal date stating the renewal date, that you may cancel, how to cancel, and that the Plan renews if you do nothing. A promotional or discounted price applies to the first term only; renewals are charged at the then-current standard price disclosed under section 11.
4.3. Failed payment. Without payment, access under a Paid Plan ends when the already-paid period expires. A failed renewal attempt does not cancel access already paid for. Whether an account then qualifies for a Free Plan depends on the Free Plan’s own conditions.
4.4. Plan changes, promotions and trials. Before you accept an upgrade, downgrade or promotion we disclose its price, effective time, any credit, and its effect on allowances and renewal. We do not make partial refunds for upgrades or renewals unless we agree to in writing. A trial or promotion does not convert into an undisclosed paid subscription; if a trial or promotional period leads to a paid Plan, the price and first charge date are disclosed before the trial starts and again by email at least 7 days before the first charge, and you may cancel before that date without charge.
4.5. Cryptocurrency. Where cryptocurrency is accepted for an Order, the payment instructions identify the supported currency and network, the pricing denomination, exchange-rate treatment and fees. Cryptocurrency payments are not eligible for the voluntary refund in section 5.3. Statutory refunds under section 5.1 are unaffected.
4.6. Payment disputes and duplicate accounts. If you dispute a charge with your card issuer or payment provider, we may suspend the affected Plan while the dispute is open and ask you for information to resolve it. A dispute made in good faith is not a breach of these Terms, and this clause does not apply to a reversal you request under a statutory right, such as section 99 of Ontario’s Consumer Protection Act, 2002. We may refuse to create, or may consolidate, duplicate accounts held by the same person where duplication is used to obtain a Free Plan, trial or refund more than once.
5. Cancellation, refunds and billing disputes
5.1. Mandatory rights. The voluntary refund policy in sections 5.3 and 5.4 supplements your statutory rights and does not restrict any cancellation, service-quality, refund or other remedy that the law does not permit us to exclude. A refund that the law requires is paid in full, without deduction and regardless of payment method or use, within the period the law sets; the conditions in sections 4.5, 5.3 and 5.4 do not apply to it. If you live in British Columbia and a term longer than 60 days has renewed, you may cancel at any time after the renewal and receive a pro-rated refund of the unused part of the renewed term within 15 days. If the law of the place where you live gives you a similar right, or a right to withdraw from a distance contract within a period after purchase, we honour it. By purchasing a Paid Plan you expressly request that the Service begin immediately, and if you exercise such a withdrawal right after the Service has begun you pay only a proportionate amount for the period supplied.
5.2. Cancellation. You may cancel by contacting customer service under section 13; any other means of giving notice that the law allows also works. Cancellation received before the next renewal stops that renewal and any further charge. Access continues until the end of the current Paid Period, subject to section 8, and we confirm the date in writing. Ordinary cancellation does not itself entitle you to a refund of the current Paid Period.
5.3. Money-back refund. If you were genuinely unable to use the Service during a Paid Period, including because a government or network blocked it, and no Successful Traffic was forwarded for your account during that Paid Period, we refund the payment for that Paid Period in full, once verified. This applies to each Paid Period separately, including renewal periods. Conditions: the request must be made within 14 days after the payment for that Paid Period; the payment must have been made by card, not cryptocurrency; and an approved refund ends access under that Plan and cancels renewal. Choosing not to use a working Service is not inability to use it. If Successful Traffic flowed during the Paid Period, the payment is not refundable under this section; monthly Plans are otherwise non-refundable. Attempting to obtain a refund by misrepresentation, or by using more than one account, is a material breach.
5.4. Verification. To request the refund, contact customer service, identify the payment and describe the problem. We use the aggregate traffic totals for your account and proportionate troubleshooting evidence; we do not ask for credentials or browsing records. Missing or incomplete metering is not proof of use or non-use; we then assess other reliable evidence. We tell you the result and you may ask for a review. Approved refunds are paid without undue delay to the original payment method where practicable and lawful.
5.5. Billing errors. We investigate reported incorrect or unauthorized charges and correct substantiated errors. Contacting us is not a condition of exercising a right against a payment provider or regulator.
5.6. Account closure. Cancelling renewal, closing an account and requesting erasure are distinct and may be requested together. A closure request also cancels future renewals. We tell you when access ends and what information we must retain. Signing out or uninstalling software does not notify us of cancellation or closure.
6. Acceptable use
6.1. You and your authorized users must not use the Service to:
(a) commit fraud, use stolen credentials, facilitate phishing or send unlawful unsolicited communications;
(b) distribute malware, operate unauthorized botnets, conduct denial-of-service attacks or obtain unauthorized access to systems or data;
(c) create, possess or distribute unlawful sexual exploitation material, or engage in unlawful threats, exploitation or harassment;
(d) infringe intellectual-property rights or unlawfully disclose another person’s confidential or personal information;
(e) interfere with the Service or other users, or evade account authorization, billing, routing restrictions or disclosed limits; or
(f) resell the Service, provide it to third parties, or provide a service to others of which VPN or proxy connectivity is a significant part.
6.2. Automated and bulk traffic. You must not use the Service for crawling, scraping, harvesting, bulk automated traffic or sustained transfers that degrade the Service, unless your Plan or Tripod in writing permits it. Peer-to-peer file-sharing protocols, including BitTorrent, are subject to the restrictions disclosed for your Plan. You may test the security of your own systems, or of systems whose owner has authorized the testing in writing, provided the testing does not harm the Service or third parties; you may not test Tripod’s infrastructure. Lawful circumvention of network blocking and legitimate criticism are not prohibited.
6.3. Abuse and copyright complaints. Complaints may be sent to abuse@tripod.sh and should identify the conduct and evidence without unnecessary personal information. We assess complaints under applicable law. A complaint alone is not proof of misconduct or authority to disclose a user’s identity. Tripod provides the means of telecommunication and does not select, modify or inspect the content it carries; where Canada’s notice-and-notice regime applies to us, we comply with its forwarding and record-keeping obligations to the extent we hold records that allow us to do so.
7. Privacy and diagnostic choices
7.1. The Privacy Policy distinguishes aggregate usage amounts, blocked-destination diagnostics, authentication records and operational logs. The Service is not supplied under a general no-logs guarantee.
7.2. Blocked-Destination Diagnostics are account-linked records of destinations rejected by routing or filtering rules, limited to connection metadata and used for troubleshooting, routing assessment, protecting the Service and enterprise-administrator visibility. They are never records of content. They may be available on Free, Paid and enterprise Plans. We obtain your consent before collecting them where the law requires, and a Paid-Plan Customer may opt out at any time for its accounts.
7.3. Opting out stops new Blocked-Destination Diagnostics for the affected account. It does not stop the usage accounting in section 3.3, which is necessary for allowances, device limits and refund verification. Historical records and privacy rights are governed by the Privacy Policy.
8. Suspension and termination
8.1. We may suspend, restrict or terminate access immediately and without prior notice where reasonably necessary to address a material breach of these Terms, a security or operational threat, a legal or sanctions requirement, or loss of paid entitlement. Measures are proportionate to the circumstances.
8.2. Where advance notice was not practicable, we explain the grounds afterwards when the law permits, and you may contact customer service to request a review and provide information.
8.3. Termination for your material breach does not entitle you to a refund of the remainder of the Paid Period, subject to mandatory rights. A restriction properly imposed for serious misuse is not, by itself, inability qualifying for a refund under section 5.3. Termination by Tripod for reasons unrelated to your breach is governed by section 11.5.
8.4. When authorization ends you must stop using the affected credentials and configurations. Provisions concerning accrued obligations, intellectual property, liability, disputes and lawful retention survive to the extent needed for their purposes.
9. Intellectual property
9.1. During authorized access you may use the Service and any Tripod-supplied software or configurations for the purposes permitted by these Terms. Tripod and its licensors retain their rights; no ownership transfers. Open-source and third-party licences govern the rights they grant and are not displaced by conflicting restrictions in these Terms.
9.2. Your traffic and content remain yours or their owner’s. You authorize only the transmission and processing needed to provide the Service, subject to the Privacy Policy and applicable law.
10. Warranties, liability and support
10.1. Service provided as is. Except as expressly stated in the Order, the Service is provided “as is” and “as available”. We do not guarantee that the Service will be uninterrupted, error-free, secure or available at any particular speed or in any particular place; that it will reach any destination or bypass any restriction; that its use will be undetectable; or that it makes you anonymous. Coverage, speed, locations and quality may vary. The Service is not designed for use where failure could cause death, injury or severe damage. You are responsible for whether your use is lawful where you use it. Nothing in this section 10 limits the deemed warranty that services supplied under a consumer agreement are of reasonably acceptable quality (Ontario Consumer Protection Act, 2002, section 9), any warranty or condition that the law of your place of residence does not permit us to exclude, or your statutory refund and cancellation rights.
10.2. Excluded losses. To the extent the law permits, Tripod is not liable for indirect, incidental, special, consequential or punitive loss; for lost profits, revenue, business, savings or data; for loss caused by government, network-operator or third-party blocking or interference with the Service; for loss arising from your unlawful use, from altered software, or from software obtained other than from Tripod or an official source; or for third-party clients, devices, networks or destination services, in each case even if we were advised of the possibility of the loss.
10.3. Liability cap. To the extent the law permits, Tripod’s total liability arising out of or in connection with these Terms and the Service, for all claims together, is limited to the greater of CAD 100 and the fees you paid Tripod for the affected Service in the twelve months before the event giving rise to the claim.
10.4. Exceptions. Sections 10.2 and 10.3 do not apply to liability for fraud, wilful misconduct or gross negligence; for death or personal injury caused by negligence; for amounts we must refund under these Terms or by law; to the deemed warranty and other rights preserved by section 10.1; or to any liability that the law does not permit us to limit.
10.5. Indemnity. You will compensate Tripod for losses, damages and reasonable legal costs from claims by third parties that are caused by your unlawful use of the Service, your breach of section 6, or infringement of a third party’s rights by you or by anyone you allow to use your account. This does not cover claims caused by Tripod’s own breach or negligence, and does not reduce any amount you are entitled to recover from us by law. Enterprise indemnities are set out in the enterprise terms.
10.6. Support and third parties. Support is provided by email on a reasonable-efforts basis without a committed response time. We are not responsible for third-party client software, your devices, the networks between you and our servers, or the websites and services you reach through the Service.
11. Changes to the Terms and the Service
11.1. What may change. We may propose changes to the following elements at intervals of not less than 30 days for a given Plan: prices; Plan features, allowances, limits and restrictions; supported protocols, configurations and locations; the acceptable-use rules in section 6; and the other provisions of these Terms, for legal, security, operational or commercial reasons.
11.2. Notice of changes. We give notice of a proposed change by email (or, for accounts without an email address, in the account portal) between 30 and 90 days before it takes effect. The notice sets out the text of each changed provision, the effective date, a free and easy way to respond, and the effect of not responding. You may decline the change by cancelling renewal before the effective date, in which case the existing terms continue until the end of your current Paid Period. A change does not affect rights you acquired before its effective date, and a price change applies only from your next Paid Period after the notice period.
11.3. Material changes to a Paid Plan. A change that materially alters the Service you receive under a Paid Plan takes effect for you only when you expressly accept it. If you do not accept, you keep the existing Service and terms until the end of your current Paid Period, and the Plan does not renew.
11.4. Changes without notice. Sections 11.1 to 11.3 do not restrict changes to a Free Plan, changes that do not materially affect your rights or the Service you receive, or changes required to comply with law or to address an urgent security threat; we give notice of the last kind as soon as practicable.
11.5. Discontinuance. If we discontinue a Paid Plan, terminate it for reasons unrelated to your breach, or materially reduce it during a Paid Period, you may end the affected Service and receive a proportionate refund of the undelivered remainder. This does not limit a greater remedy that the law provides.
11.6. Privacy changes. Changes to personal-information handling are governed by the Privacy Policy. A contract change does not authorize a new processing purpose, cancel a diagnostic opt-out or replace a required privacy consent.
12. Governing law and general provisions
12.1. Law and forum. Ontario law and the federal laws of Canada applicable there govern these Terms. If you are a Consumer, you keep every protection of the law of the place where you live that applies regardless of these Terms, and if you live in Quebec, the laws of Quebec govern and the courts of Quebec have jurisdiction. The courts of Ontario have non-exclusive jurisdiction; this does not exclude a court or regulator available to you under your own law. These Terms require neither arbitration nor waiver of a class proceeding for Consumers; after a dispute arises, you and Tripod may agree in writing to another procedure. Enterprise dispute terms are in the enterprise terms.
12.2. Reviews, complaints and interpretation. Nothing in these Terms prevents you from publishing a review of the Service or complaining to a consumer-protection or privacy authority. These Terms do not exclude a protected pre-contract disclosure, a misleading-representation claim or another mandatory remedy. An invalid provision is ineffective only to the extent of its invalidity; the rest continues where it can operate independently. Failure to enforce a provision is not a waiver.
12.3. Assignment. You may not transfer these Terms without our consent. Tripod may transfer them with the relevant business if the successor assumes our obligations, required notice and consent requirements are met, and personal information is handled lawfully. A transfer must not diminish your mandatory rights.
